U.S. District Judge Richard Leon—appointed by establishment favorite George W. Bush—issued the temporary restraining order on Thursday, giving cover to Kelly and five other Democrats who produced what critics are calling blatantly political propaganda disguised as military guidance.
The ruling represents the latest example of how deep state judges continue to obstruct President Trump's agenda, even when it comes to maintaining discipline and political neutrality within our armed forces. Secretary Hegseth had moved to censure Kelly over the controversial video that appeared to encourage military personnel to defy lawful orders from their commander-in-chief.
Another Judicial Roadblock
This decision follows a predictable pattern we've seen since Trump returned to office: every time his administration tries to drain the swamp or hold Democrats accountable for their actions, some federal judge magically appears to throw up roadblocks. Judge Leon's intervention sends a dangerous message that partisan political activism by military personnel will be protected by the courts.
Senator Kelly, a former astronaut who should know better about following chain of command, has remained defiant about his role in the video. His participation represents exactly the kind of political weaponization of our military that Americans voted to end in 2024.
"This is about maintaining the political neutrality and good order that our military requires," a defense official told reporters on condition of anonymity.
Secretary Hegseth now faces the challenge of reforming military culture while being hamstrung by activist judges who seem more interested in protecting Democratic politicians than maintaining military discipline.
